If you bought a Celsius energy drink during the past seven years, you may be eligible for compensation. Due to a class action lawsuit against the energy drink, Celsius agreed to pay $7.8 million to resolve allegations that it falsely marketed its drink as containing no preservatives.

Anyone who bought a Celsius drink between Jan. 1, 2015, and Nov. 23, 2022, is eligible to receive compensation. Celsius beverages included in the settlement include:

  • Celsius Heat
  • Celsius BCCA+Energy
  • Celsius with Stevia
  • Celsius On-The-Go powdered drinks
  • Flo Fusion powdered drinks

Why was Celsius Sued?

According to the class action lawsuit, Celsius is accused of falsely advertising that its drinks contained no preservatives. However, according to the lawsuit, the beverages contain citric acid, which is a preservative and flavoring agent. The plaintiffs in the Celsius energy drink lawsuit reported that they wouldn’t have purchased the drinks if they knew citric acid was used.

Although Celsius has denied any wrongdoing, the company agreed to settle the class action lawsuit for $7.8 million.

How Much Compensation Can You Receive?

According to the lawsuit, the amount of compensation people can receive depends on how many drinks they bought between Jan. 1, 2015, and Nov. 23, 2022.

Plaintiffs can receive payments of $1 per can and $5 for each package of 14 powdered drinks. Class members who can show proof of purchase are eligible to receive up to $250, while class members who cannot provide proof of purchase can receive up to $20.

Those figures could be adjusted depending on how many claims are filed. For example, if fewer claims are filed than expected, the numbers could change to $500 and $40, respectively, while a larger number of claims could reduce the compensation on a pro-rated basis.

What’s the Deadline for Filing a Claim?

Suppose you purchased a Celsius beverage during the designated timeframe. In that case, you have until Feb. 13, 2023 to submit a form online or have it mailed with a postmark date of Feb. 13. The final approval hearing for the settlement is March 31, 2023.

What are Your Rights and Options?

Class members have three options:

  • Making a claim. To receive a cash award, class members can visit the settlement website, www.CelsiusClassActionSettlement.com, and submit a claim form. The deadline is Feb. 13.
  • Object to the settlement. You can also object to the settlement. Objections must be mailed to the class administrator and postmarked by Feb. 13, 2023. This option excludes you from any current or future settlement from Celsius.

Opt out of the settlement. If you decide to opt out of the settlement, you must send an exclusion request that is postmarked no later than Feb. 13, 2023. This allows you to be part of a future lawsuit against Celsius regarding legal claims in this case.
